Your rights when cancelling a gym membership

There is no federal click-to-cancel rule in force: a court vacated the FTC rule in July 2025. Your rights come from state law and your agreement. Several states, including California, New York, Colorado, Vermont and Virginia, require gyms to make cancelling easier, often online.

Federal rules

The FTC’s click-to-cancel rule was vacated by the Eighth Circuit in July 2025, and no replacement has been adopted. The Restore Online Shoppers’ Confidence Act (ROSCA) still requires a simple way to stop recurring charges for memberships sold online.

States with specific rules

  • California: simple online cancellation for contracts signed on or after July 1, 2025.
  • New York: gyms must accept cancellation by website, email, phone, mail or in person, process it within 10 business days and send proof of cancellation.
  • New York City: online cancellation required even for in-person sign-ups, from October 1, 2026.
  • Colorado and Vermont: online cancellation if you signed up online.
  • Virginia: cancelling must be as easy as signing up, through each sign-up method.

Why put it in writing anyway

Online buttons fail, front desks forget and “requests to cancel” get lost. A dated letter sent by certified mail is evidence you can show your bank or your state attorney general if charges continue.

If they keep charging you

  • Send a copy of your letter and the delivery record to the gym and ask for a refund.
  • Dispute the charge with your bank or card issuer.
  • File a complaint with your state attorney general’s consumer protection office or at reportfraud.ftc.gov.
